1. Scope and provider
In the future, these conditions will regulate the use of the ARTOPIA platform by artists, organizers, agencies, locations and other registered users. The provider is Andreas Dukek-Haferkorn, ARTOPIA, Gerokweg 3, 89077 Ulm.
2. Role of ARTOPIA
ARTOPIA provides profiles, search, application, communication and booking functions. Unless ARTOPIA expressly states its own offer, the contract for a performance or other service is concluded directly between the artist and the organizer. Both sides are responsible for the scope of services, dates, remuneration, taxes, permits, insurance and implementation.
3. Registration and Account Security
- Registration information must be true, current and complete.
- Users must be of legal age and have legal capacity or must be effectively represented.
- Access data may not be passed on.
- Organizations may only be represented by authorized persons.
- Multiple or fake profiles as well as identity deception are not permitted.
4. Profiles and User Content
Users remain the owner of their content and only grant ARTOPIA the non-exclusive usage rights necessary for the display, technical processing and promotion of the profile. They guarantee that they are allowed to publish images, music, videos, texts, logos and personal information.
Illegal, discriminatory, violent, misleading or violating third-party rights content is prohibited. They regulate the details Platform rules.
5. Tenders, offers and bookings
Tenders and offers must transparently describe the essential conditions, in particular date, location, performance, remuneration, technical requirements and, if applicable, travel or additional costs. A booking only becomes binding once the contractual step has been clearly identified in the booking process.
Fees, commissions, payment service providers, cancellation conditions, cancellation rights and payout deadlines are clearly displayed before the respective function is activated. ARTOPIA does not store or transfer payments unless an expressly designated payment service is set up.
6. Reviews
Reviews must only be based on real contacts or bookings, must remain factual and must not disclose confidential or unnecessary personal data. Purchased, fictitious, extortionate reviews or reviews demanded in return are not permitted. In principle, both sides are given the opportunity to comment.
7. Reporting, Moderation and Review
ARTOPIA may review, limit visibility or remove content and temporarily or permanently restrict accounts for violations of the law, security risks or violations of these Terms. Those affected generally receive a comprehensible justification and – if provided for by law – an opportunity to complain and have a human review.
8. Availability and Changes
There is no right to uninterrupted availability at all times. Maintenance, security measures and further developments may temporarily change functions. Significant changes to the conditions will be communicated in a timely and transparent manner.
9. Liability
ARTOPIA is liable without limitation in the event of intent, gross negligence, injury to life, body or health and in cases of mandatory statutory liability. Otherwise, liability depends on the legal provisions and the specific role of ARTOPIA as a platform or its own contractual partner.
10. Termination and Suspension
Users may terminate their account following the procedures provided later in the account. Statutory retention obligations remain unaffected. In the event of serious or repeated violations, ARTOPIA may suspend or terminate the contract after appropriate review.
11. Applicable Law
German law applies in compliance with mandatory consumer protection regulations. Agreements on jurisdiction only apply to the extent that they are legally permissible and effectively agreed.
